On Wednesday, December 4, Burns White hosted an Employment Law Webinar, Weed at Work: An Introduction to Medical Marijuana in the Workplace, featuring Meghan Campbell, Esq. With the legalization of medical marijuana in Pennsylvania in 2016, employers are faced with new challenges addressing medical marijuana in the workplace. These challenges include drug testing, drug-free workplace policies, discrimination, whether an employee can be under the influence of marijuana at work, and how medical marijuana intersects with the Americans with Disabilities Act among others. We discussed the background of the Pennsylvania Medical Marijuana Act, who is eligible for medical marijuana, what employers are required and/or prohibited from doing in regard to employees who use medical marijuana, and recent developments in both state and federal law in an effort to address some of the challenges employers are facing.
