On September 15, 2025, attorney Colleen Mountcastle obtained summary judgment in favor of a railroad defendant in a toxic tort cancer case in the Circuit Court for the County of Calhoun, Michigan. The Plaintiff alleged that he developed cancer as a result of exposure to toxic substances throughout his railroad career. The court found that Plaintiff did not act with reasonable diligence to investigate the cause of his cancer and his claims brought under the Federal Employers’ Liability Act were filed outside of the applicable statute of limitations. The time-barred complaint was entirely dismissed and judgment was awarded in favor the railroad.
