Attorneys O’Neal, Baron Funaro & Ha Receive Dismissal for Resident Physician

Burns White trial attorneys Stuart T. O’Neal, III and Kimberly M. Baron Funaro, along with attorney Na Lee Ha and paralegal Ann Konchinsky, received a summary judgment dismissing all claims with prejudice against a second-year resident physician in the Dauphin County Court of Common Pleas in a medical malpractice action involving allegations of birth injury. The resident had been joined in the action by the hospital. However, following disclosure of Plaintiffs’ expert reports, which contained no allegations of negligence towards the resident, the Court granted summary judgment and dismissed all claims against him with prejudice.
