The COVID-19 pandemic has forced nursing homes and other senior living facilities to implement new state, federal, and agency mandates, as well as deal with the unprecedented number of operational challenges and liability risks associated with COVID-19.
Objectives:
- Examining governor Wolf’s May 6, 2020 Executive Order and anticipating its application and limits
- Exploring a possible alternative to the limited application of Governor Wolf’s executive order: the PREP Act and the HHS Amendments and Declarations
- Reviewing a framework for seeking removal of an action to Federal Court to trigger the PREP Act
