Attorneys Dave Johnson and Joe Peluso secured a Court Order dismissing a surgeon and his practice group from a medical malpractice lawsuit filed in Erie County. The dismissal occurred following a Motion for Summary Judgment based on an analysis of the expert reports filed by the plaintiffs.
The case, which arose from care and surgery occurring during the pandemic, involved numerous parties and claims. Plaintiff alleged that plaintiff’s decedent died as a result of surgery performed while he allegedly had Covid, which was not known at the time the operation was performed.
