The Burns White Trial Team of Stuart T. O’Neal, Courtney Barbacane, and paralegal Ann Konchinsky obtained a global defense verdict (in conjunction with counsel representing two doctors) in a medical malpractice case, on behalf of a hospital client, after an 8-day trial in Luzerne County, Pennsylvania. The case involved allegations of a collective failure to recognize/diagnose a transient ischemic attack (“TIA”) during an Emergency Department visit. It was further alleged that Defendants increased Plaintiff’s risk of harm, resulting in a subsequent stroke with residuals. Plaintiffs’ claims against the Hospital included a claim for vicarious liability against the emergency medicine providers. The Plaintiffs’ demand was $12 million, with the Jury awarding $0.
