Attorneys Stuart O’Neal, Daniel Margonari, and Ken Rafferty, as well as Senior Paralegal Dawn Keiser, successfully obtained dismissal with prejudice on behalf of prison medical providers in the United States District Court for the Western District of Pennsylvania. The Plaintiff, a former prisoner, brought claims pursuant to 42 U.S.C. § 1983 and the Eighth Amendment relating to his diabetic medical treatment. Burns White successfully argued that the Plaintiff failed to pursue claims against the medical providers. As such, the Magistrate Court recommended that the case be dismissed against the medical providers.
