Attorneys Dave Johnson and Ashley Griffin have secured a court order dismissing a six-count complaint against a hospital defendant, arising from a claim that the decedent was treated with Remdesivir, rather than Ivermectin during COVID-19.  Plaintiff alleged that the drug was given without the decedent’s consent due to a giant conspiracy and financial incentives.

The 30-page complaint included claims that:

  • Remdesivir was used as “a medical deception” during the Covid-19 pandemic to inappropriately treat patients
  • That Remdesivir is a dangerous, experimental drug that was pulled from Ebola Controlled Trials because of high death rates of up to 53%.
  • That Remdesivir is a dangerous drug known to cause lungs to fill up with fluid, cause kidney poisoning, and other organ damage (such as heart damage, heart attacks and bradycardia).
  • That Remdesivir was approved for emergency treatment of Covid in May 2020 by the NIH, who had financial ties to Gilead Sciences, the manufacturer of Remdesivir.
  • That Remdesivir was given to patients during the Covid pandemic against their wishes, in violation of the Nuremberg Code which addresses consent surrounding human experimentation. 

Preliminary objections were filed to each Count of the Complaint.

After argument, following by a scheduled evidentiary hearing, the Court dismissed the case on the basis that Plaintiff’s counsel  had failed to engage in good faith efforts to serve the Complaint after it was filed in October, 2023. In view of this decision, the Court did not reach the substantive issues presented by the Complaint and the remaining Preliminary Objections.
