Attorneys O’Neal, Margonari, Rafferty & Team Obtain Dismissal with Prejudice on Behalf of Prison Medical Providers

Attorneys Stuart O’Neal, Daniel Margonari, and Ken Rafferty, as well as Senior Paralegal Dawn Keiser, successfully obtained dismissal with prejudice on behalf of prison medical providers in the United States District Court for the Eastern District of Pennsylvania.  The Plaintiff, a prisoner, brought claims pursuant to 42 U.S.C. § 1983 regarding the medical treatment that he received for side effects he experienced after receiving the COVID-19 vaccine.  Burns White successfully argued that the Plaintiff failed to allege sufficient facts that the “provision of medical care was both inadequate and motivated by improper or non-medical reasons.” As such, the District Court dismissed the case with prejudice.
