Alexandersen and Hamilton Obtain Summary Judgement for Large Manufacturer

Attorneys Kevin Alexandersen and Brooke Hamilton obtained a summary judgment motion for a large forklift manufacturer in a mesothelioma asbestos case filed in Defiance County Court of Common Pleas.  Plaintiff alleged claims for strict liability, negligence, and punitive damages, arguing that the defendant’s forklifts incorporated asbestos-containing components that caused the plaintiff’s disease. In the summary judgment motion, the defendant argued that there was no direct evidence of exposure to alleged asbestos-containing components. The trial court agreed with defendant’s position that even though the plaintiff was entitled to “reasonable inferences”, too many inferences “becomes so attenuated as to result in mere speculation.” Mr. Alexandersen and Ms. Hamilton are pleased with the outcome of this matter, as it is often difficult to obtain a favorable result in exposure cases.
