Attorneys Jeffrey Jackson and Joshua Brown obtained a summary judgment for a large railroad carrier in a cancer case filed in the United States District Court, Northern District of Alabama. Plaintiff alleged he developed kidney and brain cancer secondary to diesel exhaust, creosote, and asbestos while working at Norfolk Southern as a locomotive engineer in and around Montgomery, AL. Attorneys Jackson and Brown filed a motion for summary judgment under statute of limitations, alleging Plaintiff had no capacity to bring a lawsuit on behalf of the estate before the expiration of the statute of limitations. The court agreed, granting the motion and dismissing the case.
