Attorney Courtney Barbacane obtained a defense verdict, in conjunction with counsel for the physician, on behalf of a hospital, in a medical malpractice case venued in Luzerne County, PA. The case involved an alleged failure to identify a Central Venous Thrombosis (“CVT”) on an MRI of the Brain, resulting in visual deficits. Plaintiffs’ claims against the Hospital were limited to vicarious liability for the radiologist, after Barbacane secured complete dismissal of the corporate liability claim. The Plaintiffs’ initial demand was $7+ million. Following the introduction of testimony from key fact and expert witnesses, the arbitrator found no factual cause of injury and entered a defense verdict.
This is Courtney’s second defense verdict in two weeks, in two cases, involving alleged failures to prevent stroke.
