On December 8, 2023, Attorneys John Bass and Meghan Matscherz obtained the dismissal of several Defendants by way of Summary Judgment in the Court of Common Pleas of Allegheny County, Pennsylvania. The case involved a workplace slip and fall that occurred while Plaintiff was carrying a large tray of cookies through the parking lot of a skilled nursing facility in Oakmont, Pennsylvania. Bass and Matscherz moved for Summary Judgment, arguing, inter alia, that Defendants were entitled to summary judgment as a matter of law because (1) none of the Defendants were in possession and/or control of the premises at the time of the fall and (2) Plaintiff’s exclusive remedy was Workers’ Compensation as the possessor of the premises was Plaintiff’s statutory employer. After briefing and oral argument, Judge Arnold Klein partially granted Defendants’ Motion for Summary Judgment and dismissed 5 of the 6 Defendants in the action.
