Robert E. Dapper, Jr. and his team recently obtained a defense verdict on behalf of an insurer in a bad faith case following a week-long jury trial in the United States District Court for the Eastern District of Pennsylvania. The Plaintiff alleged that the insurer had failed to timely and adequately investigate, evaluate, and resolve her claim for underinsured motorist benefits. However, the insurer countered that there were legitimate questions requiring further investigation, that there was a genuine dispute on value, and that the claim was appropriately resolved after the conclusion of the investigation. The jury concluded that the insurer did not act in bad faith and found in favor of the insurer.
