Attorney Carol Cowhey recently obtained a defense verdict on behalf of a hospital in a binding arbitration involving claims under the Mental Health Procedures Act. The case involved a patient with dementia who fell while in a locked psychiatric unit, suffered a hip fracture requiring surgical repair, and subsequently passed away. Ms. Cowhey was able to establish not only that staff met the standard of care, and were not grossly negligent, but also that the death was unrelated to the fall.
