Attorney Cowhey Obtains Dismissal of Physician in Medical Malpractice Case

Burns White Attorney Carol Cowhey obtained the dismissal of a physician in a medical malpractice case following jury selection in Philadelphia County Court of Common Pleas when the court granted her motion to disqualify plaintiff’s experts based on a lack of proper credentials under the MCARE Act. The court found that where the physician defendant was board-certified in physical medicine and rehabilitation and the plaintiff’s expert practiced in emergency medicine and sports medicine, they lacked sufficient education and experience to offer standard-of-care testimony.
