Burns White attorneys, Mark Hartig, Albert Rodriguez, and Ed Carbone obtained a final summary judgment on behalf of a Medical Group accused of failing to properly supervise its nursing staff and staff physicians accused of negligence by a patient. The claimant sued the clinic for common law negligent hiring, retention, and supervision of the physician and negligent training and supervision of the clinic’s staff who alleged both the clinic and staff’s negligence resulted in serious injuries. The claimant also alleged that the Medical Group engaged in a “Negligent Mode of Operation.”
A Sarasota County Circuit Judge granted the Medical Group’s Motion for Final Summary Judgment dismissing all claims. The detailed order noted that three (3) years of extensive discovery had occurred and the claimant had not met their burden to allow the case to go to a Jury Trial, dismissing the case. The Defense will now have a claim for fees and costs as the prevailing party.
