Attorney Mintz Secures Complete Dismissal for Nursing Home Community

On March 11, 2025, Attorney Philip Mintz secured a complete dismissal of all claims against a nursing home community via a Motion for Judgement on the Pleadings in Montgomery County, PA. The Plaintiff alleged that they sustained injuries following a slip and fall on a dangerous/defective condition at the property.  Burns White successfully argued that the Community was immune from tort liability under the Worker’s Compensation Act and its Exclusive Remedy Doctrine. The Montgomery County Court of Common Please agreed with the position of Burns White and granted the complete dismissal of all claims against the Community, as the Court found that it was clear from the pleadings that the Plaintiff accepted workers’ compensation benefits for the injuries at issue and was bound by that acceptance.
