O’Neal and Sottile Obtain Dismissal of Healthcare Organization on New Jersey Negligence Action

Burns White attorneys Stuart O’Neal and Mark Sottile obtained a complete dismissal of a negligence matter on behalf of a healthcare provider and several named Defendants. Attorneys O’Neal and Sottile put forth a variety of arguments in a Motion to Dismiss, which the Court found palatable, namely the Plaintiff’s failure to “articulate a legal basis entitling” her to relief. Citing a string of cases, the Motion also successfully argued that Plaintiff’s Complaint failed to state any basis for relief and that as a result, discovery would prove futile.
