O’Neal, Tanker Defend $16,000,000 Case For Client

After eight days of trial before The Honorable Thomas Burke and a jury of 12 citizens in Luzerne County, a defense verdict was returned in favor of a hospital and a nurse, among others, accused of negligence and causing the death of a 44-year-old man who was presented to the emergency room with pneumococcal pneumonia and sepsis. The Burns White trial team of Stuart T. O’Neal and Marcy B. Tanker led the defense and tried the case on behalf of the hospital and the nurse. The plaintiff claimed that the medical care was allegedly mismanaged and contended that the hospital had altered the medical records. In addition to critical care, emergency medicine, pathology, and neuroradiology experts, the team utilized a medical informatics expert to defeat all Plaintiff’s claims.
