The Burns White trial team of Stuart T. O’Neal, Jody Healey, and Bill D’Annunzio successfully defended a Scranton-based hospital with no settlement contribution on its behalf in a Lackawanna County medical malpractice case which ultimately settled for over seven figures with payment by the Co-Defendant Surgeon and Emergency Room Physician and Group. The matter was slated to be tried before Judge Julia Munley in the second week of October.
Specifically, the case involved a delay in diagnosis and treatment of osteomyelitis of the Plaintiff’s jaw requiring 4 reconstructive surgeries including the implantation of a portion of the Plaintiff’s femur bone in the jaw. The Burns White Team retained experts in Emergency Medicine, Oral and Maxillofacial Surgery, and Infectious Disease and were successful in obtaining partial summary judgment on the theory of Hospital Corporate Liability.
The case resolved the Friday before Jury selection following three settlement conferences before Judge Munley.
