Attorneys Hart & Stadler Obtain Summary Judgment for Nursing Home Client, Upheld by WV Supreme Court of Appeals

In a matter that was commenced in Cabell County, West Virginia, attorneys Douglas Hart and Mark Stadler successfully defended claims asserted against a nursing home client based on successor liability. Plaintiff’s claims were based on claims of negligence that allegedly resulted in the death of a resident prior to the client assuming operation of the subject facility. After months of strategic discovery, Hart and Stadler received a summary judgment ruling in favor of the nursing home client and dismissing Plaintiff’s claims under a theory of successor liability.

Following Plaintiff’s appeal, Hart successfully argued the client’s position before the West Virginia Supreme Court of Appeals, who ultimately affirmed the lower court’s summary judgment ruling and the dismissal of Plaintiff’s claims.
