Burns White attorneys Stuart O’Neal, Lyle Washowich, and Ken Rafferty successfully removed a class action suit to Federal court under the Class Action Fairness Act (“CAFA”), resulting in Plaintiff’s voluntary dismissal of the case in its entirety. The class action suit was filed against three hospital-based entities with alleged violations under the Pennsylvania Wiretapping and Electronic Surveillance Control Act (“WESCA”), along with additional and related claims. Plaintiff alleged that patients submitted data through the hospital’s website that was allegedly shared with third-party entities in violation of WESCA and the related claims. Plaintiff voluntarily dismissed the case after facing a strong defense and proper removal under CAFA.
