Attorneys Rebelo, Pohl & Brennan Win Full Federal Court Dismissal on Behalf of Steel and Railroad Clients

On September 12, 2022, U.S. District Judge Robert J. Colville (U.S. District Court for the Western District of Pennsylvania) entered an order dismissing, with prejudice, all claims against Burns White’s clients, consisting of a steel-industry client, two railroads, and three individually-named employees.  The claims in the case alleged violations of the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and the Pennsylvania Human Relations Act (PHRA).  The result achieved was that all claims made against all six of Burns White’s clients were entirely dismissed by the Court, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, for continued failure to state viable claims after two amendment attempts by plaintiff.
