Daniel Twilla Obtains Defense Verdict in Bad Faith Case

Attorney Daniel J. Twilla recently obtained a defense verdict on behalf of an insurer in a bad faith case following a non-jury trial in the Court of Common Pleas of Philadelphia County, Pennsylvania. The Plaintiffs alleged that the insurer had failed to timely and adequately investigate, evaluate, and resolve their claims for uninsured motorist benefits. However, the insurer countered that there were legitimate questions requiring further investigation of liability for the underlying automobile accident, that there was a genuine dispute regarding the value of the Plaintiffs’ injuries arising out of the accident, and that the insurer’s position at arbitration was reasonable. The court concluded that the insurer did not act in bad faith and found in favor of the insurer.
