Burns White’s New Jersey office secured a complete defense verdict following a jury trial in the Superior Court of New Jersey, Camden County, on behalf of a skilled nursing facility.
The case involved claims of negligence and alleged violations of the New Jersey Nursing Home Responsibilities and Rights of Residents Act. Plaintiff, as Administrator of her grandmother’s estate, alleged that the skilled nursing facility failed to provide appropriate nursing care, leading to the development and progression of a pressure injury that allegedly became infected and ultimately caused her grandmother’s death.
After hearing the evidence, the jury returned a unanimous verdict in favor of the defense. The verdict was reached in less than one hour of deliberations, demonstrating the strength of the defense presented at trial and resulting in a complete victory for Burns White’s client.
This trial marks the third nursing home jury trial in 2026 for Burns White’s New Jersey trial team. In each of the prior two trials, the team successfully defended against claims brought under the New Jersey Nursing Home Responsibilities and Rights of Residents Act, defeating the statutory resident-rights claims and the significant attorney’s-fee exposure associated with them. Although the juries returned negligence verdicts in those matters, those decisions are currently being challenged on appeal. This latest verdict represents a complete defense victory on all claims.
