Attorneys Palmer, Perrache & Jones Obtain Summary Judgment for Major Railroad Carrier

On January 5, 2024, Attorneys Edwin Palmer, Lisa Perrache, and Melanie Jones obtained summary judgment for a major railroad carrier in a lawsuit arising out of a fatal motor vehicle collision filed in Gloucester County, New Jersey. Because the railroad had a railroad-grade crossing near the roadway intersection where the accident occurred, Plaintiffs alleged that the railroad failed to provide appropriate signage for the roadway intersection. Burns White successfully argued that the railroad had no duty under New Jersey law to provide signage at a roadway intersection and that public policy weighs against requiring private entities, such as railroads, to be responsible for ensuring the safety of motorists on public roads.
